These Terms and Conditions of Sale (referred to as “T&Cs”) apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers (“The Clients or the Client”) wishing to purchase the products offered for sale (“The Products”) by the Seller on the website https://www.o-medina.com. The Products offered for sale on the site are as follows: Cosmetics (Perfume, beard oils), Home Fragrances (Incense).
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, are presented on the website https://www.o-medina.com, which the Client must review before placing an order, in accordance with the Terms and Conditions of Sale (referred to as “T&Cs”).
The choice and purchase of a Product are the sole responsibility of the Client.

The Products listed on the website https://www.o-medina.com are offered for sale in the following territories: Europe, Belgium, Spain, Poland, Italy, Portugal, England, and the United States.
In the case of an order to a country other than mainland France, the Client is considered the importer of the Product(s) concerned. For all Products shipped outside the European Union and French overseas territories, the price will be automatically calculated excluding taxes on the invoice. Customs duties, local taxes, import duties, or state taxes may be applicable and are the sole responsibility of the Client, as stipulated in the Terms and Conditions of Sale (referred to as “T&Cs”).
ARTICLE 2 – Price
The Products are provided at the current rates listed on the website https://www.o-medina.com at the time of order placement. Prices are expressed in Euros, excluding and including taxes. The rates take into account any discounts offered by the Seller on the website.
These rates are fixed and non-revisable during their validity period; however, the Seller reserves the right to modify prices at any time outside the validity period.
Prices do not include processing, shipping, transport, and delivery fees, which are billed additionally and specified before order confirmation.
The payment requested from the Client corresponds to the total purchase amount, including these fees. An invoice is issued by the Seller and provided to the Client upon delivery of the ordered Products.
ARTICLE 3 – Orders
The Client may select the Products they wish to order on the site. The online ordering process includes product selection, adding to the cart, information validation, and choosing the delivery method. The order will be considered final after the Client’s acceptance of these T&Cs and full payment.
The Seller reserves the right to cancel or refuse any order from a Client in the event of a dispute regarding the payment of a previous order.

ARTICLE 4 – Payment Terms

The ordered Products will be delivered within Europe and internationally within a period of less than two weeks, except in cases of force majeure. If the Products are not delivered on time, the Client may request contract termination and receive a refund within 14 days of contract cancellation.

The transfer of ownership of the Products occurs upon order confirmation, regardless of the payment or delivery date.
ARTICLE 7 – Right of Withdrawal
The Client has a 14-day period to exercise their right of withdrawal. The Products must be returned in their original condition, and return shipping costs are the responsibility of the Client.
ARTICLE 8 – Warranties
The Products are covered by the legal warranty of conformity and the warranty against hidden defects. The Client must report any non-conformity in writing.
ARTICLE 9 – Personal Data
The Client’s personal data is collected and processed in accordance with applicable regulations. The Client may exercise their rights to access, modify, delete, or transfer their data by contacting the Seller at the provided address.
ARTICLE 10 – Intellectual Property

ARTICLE 11 – Applicable Law – Disputes
These T&Cs are governed by French law. In case of a dispute, the Client may resort to a mediator or the European Online Dispute Resolution platform.
